Terms of Service
Last updated October 27, 2026
Draft pending legal review. This text may change before it is final.
These terms are an agreement between the company that operates this service ("we", "us") and the business that creates an account ("you", the "Customer"). By creating an account or using Txting you agree to them on behalf of your business.
1. The service
Txting lets your team send and receive text messages, run text campaigns, automations and an AI assistant, and manage contacts, using a Twilio account that you own and connect. We provide the software; Twilio (or another carrier you choose) delivers the messages.
2. Your account and team
- You are responsible for everyone you add to your account and for keeping logins secure.
- You must be authorized to bind your business to these terms.
3. Your Twilio account and carrier fees
Messages are sent through your own Twilio account. Twilio bills you directly for numbers, messages, carrier fees, lookups and registration (such as A2P 10DLC). You are responsible for keeping that account in good standing and for any registration the carriers require.
4. Consent and messaging laws
You are solely responsible for the messages you send, including messages sent by automations or the AI assistant, and for complying with every law and carrier rule that applies, including the Telephone Consumer Protection Act, FCC rules, state telemarketing and mini-TCPA laws (for example Texas SB 140 and Florida's law), the CTIA Messaging Principles, and carrier 10DLC policies. In particular you agree to:
- text only people who gave you the consent the law requires for that kind of message;
- honor opt-out requests, including requests made in plain language, promptly;
- keep records of consent and provide them to us or a carrier on request;
- follow our Acceptable Use Policy.
Txting's compliance features (opt-out handling, blast hours, opt-out footers) are tools to help you; they do not make your messages compliant on their own and are not legal advice.
5. Plans, billing and trials
Paid plans renew automatically each billing period until cancelled. Fees are charged through our payment processor (Stripe) and are non-refundable except where the law requires otherwise. If payment fails or a trial ends without a plan, sending may be paused until billing is updated. We may change prices with at least 30 days' notice before your next renewal.
6. Your data
You own the contacts, messages and other content you put into Txting ("Customer Data"). You give us permission to store and process Customer Data only to provide and support the service, as described in our Privacy Policy. You are responsible for having the right to upload and use it.
7. Suspension and termination
You may cancel at any time. We may suspend or end an account that breaks these terms or the Acceptable Use Policy, creates legal or carrier risk, or doesn't pay. After termination you may request an export of your Customer Data for 30 days, after which we may delete it.
8. Disclaimers
The service is provided "as is". We don't guarantee that every message will be delivered, delivered on time, or not filtered by carriers, that AI-generated replies are accurate, and we aren't responsible for outages of Twilio, carriers, hosting providers or other third parties.
9. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
10. Indemnity
You will defend and indemnify us against claims arising from your messages, your contacts' consent, your Customer Data, or your breach of these terms or of messaging laws.
11. Changes and governing law
We may update these terms; we'll tell account admins about material changes before they take effect. These terms are governed by the laws of Texas.
